The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: āClientā, āYouā and āYourā refers to you, the person accessing this website and accepting the Companyās terms and conditions. āThe Companyā, āOurselvesā, āWeā, āOurā and āUsā, refers to our Company. āPartyā, āPartiesā, or āUsā, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Clientās needs in respect of provision of the Companyās stated services/products, in accordance with and subject to, prevailing law of United States. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Product Availability:
All products are subject to previous sales, even if part is stated as āIN STOCKā when order is placed
PRICES:
Prices listed are in US Dollars, do not include freight, handling fees, taxes, and/or duties, and are subject to correction or change without notice. Market sensitive commodity products will be priced according to current market conditions.
Payments:
JOVAL INDUSTRIAL LLC accepts cash, checks, money orders, PAYPAL, Visa, MasterCard, and American Express and bank wire transfers. For customers with established JOVAL INDUSTRIAL LLC credit, payment terms are net thirty (30) days from the date of shipment or pick-up of products. All credit extended by JOVAL INDUSTRIAL LLC and the limits of such credit, is at JOVAL INDUSTRIAL LLCās sole discretion, and may be reduced or revoked by JOVAL INDUSTRIAL LLC at any time, for any reason. As a condition for the continued extension of credit, customer agrees to provide JOVAL INDUSTRIAL LLC with current credit information and the latest annual financial statement within five (5) business days following request by JOVAL INDUSTRIAL LLC. JOVAL INDUSTRIAL LLC reserves the right to charge a convenience fee for late payments. JOVAL INDUSTRIAL LLC further reserves the right to charge customer a late payment fee at the rate of one and one-half percent (1-1/2%) of the amount due for each month or portion thereof that the amount due remains unpaid, or such amount as may be permitted under applicable law. Anticipation and cash discounts are not allowed. All payments must be made in U.S. dollars.
Company & Cashier Checks:
All company & Cashier Checks are subject to a 5 business day waiting period before any products are ordered or released. We cannot guarantee the availability of a product by the time funds clear or payment is received. We will charge a $25 fee on all returned checks.
Credit Card Surcharge:
All orders over US$ 5000 will be imposed a 3% credit card surcharge however accepting credit card as a form of payment above US$ 5000 will be at JOVAL INDUSTRIAL LLC discretion
Sales Tax:
JOVAL INDUSTRIAL LLC only collects sales taxes in the state of Florida USA unless buyer can present a valid re-sell certificate or other Florida state approved tax exemption certificate.
Shipping Policy:
All pricing, written quotes/proposals and verbal quotes are EXW works incoterms unless a shipping price is clearly stated. Some products may not be eligible for drop shipping from the factory therefore an incoming freight charge to JOVAL INDUSTRIAL LLC will be imposed, some products will be shipped straight from the supplier at JOVAL INDUSTRIAL LLCās discretion. Not all products will be shipping out of Miami FL. For export customers, all custom and duties will be the customerās responsibility. JOVAL INDUSTRIAL LLC will not be responsible for damages or lost packages due to undeliverable or refused orders. All Orders received before 3:00PM eastern time will ship the same day, provided the product ordered is in stock. Most orders received after 3:00 PM eastern time will ship the next business day. Orders are not processed or shipped on Saturday or Sunday, except by prior arrangement. We cannot guarantee when an order will arrive. JOVAL INDUSTRIAL LLC is not responsible for late deliveryās. Consider any shipping or transit time offered to you by JOVAL INDUSTRIAL LLC or other parties only as an estimate.
Title:
Title of Goods shall not pass to the Buyer until the Seller has been paid in full 100% for the Goods
Returns:
Accepted within 30 days of invoice date. Do not return back to the manufacture or to us without a valid RMA provided by JOVAL INDUSTRIAL LLC. RMAās must be clearly posted on the outside box. All products returned must be well packaged and well protected when returning, all return shipping costs, custom duties and fees is the customerās responsibility. Products will be subject to an inspection and quality or part and/or packaging must meet our standards in order for the return to be approved, if denied, customer is responsible for retrieving back the product and all associated reshipping costs. Shipping is non-refundable in any scope of the transaction/return. JOVAL INDUSTRIAL LLC will not be responsible for any damaged or lost returns from the customer. There will be an 22% restocking fee on all accepted returned products. Absolutely no returns on electrical parts or special ordered items.
Warranty:
Manufactureās standard terms and conditions apply. JOVAL INDUSTRIAL LLC distributes brand new factory products and does not manufacture any goods. For Warranties including defective claims, the buyer must adhere to the manufacturerās standard practices and warranty protocol procedures. Failure to do so will result in denial of claim and any expenses/fees associated to this will be the buyerās responsibility.
Storage Fees:
All orders not picked up within 30 days will automatically be imposed a storage fee of $25 starting the 31st day after the ready date and every 30 days after until order is picked up. Additional storage will be billed separately
Website Information:

Product depictions in the catalogs and websites are for illustrative purposes only. Customer shall have no right, title, or interest in the trade names, trademarks, trade dress, copyrights, patents, domain names, product names, catalogs or any other intellectual property rights (āIPā) reserved by JOVAL INDUSTRIAL LLC, or any IP owned by manufacturers and/or suppliers to JOVAL INDUSTRIAL LLC. All materials contained in JOVAL INDUSTRIAL LLC catalogs or on its web sites are subject to the ownership rights of JOVAL INDUSTRIAL LLC and its manufacturers and/or suppliers. Customer shall have no right to copy or use of JOVAL INDUSTRIAL LLC or its manufacturers and/or suppliers without JOVAL INDUSTRIAL LLCās permission.
Cancellation:
All product order cancellations, if not prohibited above, must be approved by JOVAL INDUSTRIAL LLC, and may be denied or subject to restocking fees and other charges, even if the product has not shipped
Typographical Errors:
In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Our Store shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Our Store shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Our Store shall immediately issue a credit to your credit card account in the amount of the incorrect price
Export Controls And Related Regulations:
Customer represents and warrants that it is not designated on, or associated with, any party designated on any of the U.S. government restricted parties lists, including without limitation, the U.S. Commerce Department Bureau of Industry and Security (āBISā) Denied Persons List; Entity List or Unverified List; the U.S. Treasury Department Office of Foreign Assets Control (āOFACā) Specially Designated Nationals and Blocked Persons List; or the U.S. State Department Directorate of Defense Trade Controls (āDDTCā) Debarred Parties List. Customer shall comply with all applicable U.S. economic sanctions and export control laws and regulations, including without limitation, the regulations administered by OFAC, the Export Administration Regulations administered by BIS, and the International Traffic in Arms Regulations administered by DDTC.
